These Terms of service (“Terms”) govern your purchase and use of Shopify themes and license keys from Genius Maker Themes (“we”, “us”, “our”) at geniusmakerthemes.com and related services. By placing an order or using our themes, you agree to these Terms.

If you do not agree, do not purchase or use our products.

1. About our products

We sell digital Shopify themes and software licenses. A theme is design and code software for your online store. A license grants you permission to install and use that theme on a limited number of stores according to your plan.

We may update themes, documentation, or licensing systems from time to time. We do not guarantee that any particular feature will remain unchanged forever, but we aim to keep products usable on current Shopify platform requirements.

1. License grant and restrictions

When you purchase a theme, we grant you a limited, non-exclusive, non-transferable license to:

• Download and install the theme on your own Shopify store(s); and
• Use the theme for your store’s operation, subject to the store limit of your plan.

You may not, unless we expressly allow it in writing:

• Resell, redistribute, sublicense, or share the theme files or license keys;
• Publish the theme files for download by others;
• Remove, bypass, or tamper with license validation or enforcement;
• Use one license key on more stores than your plan allows;
• Claim ownership of the theme’s underlying code or resell it as your own product.

Each license key may be connected to one store domain (per theme) at a time unless your plan states otherwise. You are responsible for keeping keys confidential.

We may suspend or revoke licenses if we reasonably believe there is fraud, unauthorized sharing, chargebacks, refunds (where processed by a payment provider), or breach of these Terms.

1. Software provided “as is”

Themes are provided “as is” and “as available”, without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, title, or non-infringement, to the fullest extent permitted by applicable law.

We do not warrant that:

• The theme will be uninterrupted, error-free, or free of defects;
• The theme will work with every Shopify app, custom code, browser, or device;
• The theme will remain compatible with all future Shopify platform changes;
• Results from using the theme will meet your expectations.

Your store’s appearance and behaviour may be affected by your settings, apps, customizations, third-party scripts, and Shopify platform updates. You are responsible for testing the theme on your store before relying on it for live business operations.

1. No earnings, sales, or results guarantee

IMPORTANT — READ CAREFULLY

Genius Maker Themes does not guarantee, promise, or imply that purchasing or using our themes will increase your revenue, sales, profit, conversion rate, traffic, rankings, or any other business outcome.

Any examples, testimonials, case studies, screenshots, demo stores, or marketing statements that mention revenue, sales, growth, or performance describe individual results only. Results vary widely and depend on factors outside our control, including but not limited to:

• Your products, pricing, and inventory;
• Your brand, marketing, and advertising;
• Your traffic sources and audience;
• Your operations, customer service, and fulfilment;
• Market conditions, seasonality, and competition;
• Shopify platform policies and third-party apps you use.

No results are guaranteed. Past or example results do not predict your results. You purchase our themes for their design and software features, not as an investment, income opportunity, or business guarantee.

1. Your responsibilities

You agree to:

• Provide accurate information at checkout and in your account;
• Connect each license to the correct myshopify.com store and paste keys only as instructed;
• Comply with Shopify’s terms of service and all laws that apply to your business;
• Not use our themes for unlawful, misleading, or infringing purposes;
• Maintain backups of your store and theme customizations.

1. Support

We provide help for license activation and reasonable product-related questions at geniusmakerthemes@gmail.com. Support does not include custom development, app integration debugging for third-party apps, or guaranteed response times unless we offer a separate paid support agreement.

1. Refunds

All digital theme sales are final. See our Refund policy for full details. By purchasing, you agree that refunds are not available for digital downloads and license keys once issued, subject to mandatory consumer law in your jurisdiction.

1. Limitation of liability

To the fullest extent permitted by applicable law, Genius Maker Themes and its owners, directors, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, goodwill, or business opportunities, arising from or related to your purchase or use of our themes or licenses, even if we have been advised of the possibility of such damages.

Our total aggregate liability for any claim arising from a specific order shall not exceed the amount you paid us for that order.

Some jurisdictions do not allow certain limitations of liability; in those cases, our liability is limited to the maximum extent permitted by law.

1. Indemnity

You agree to indemnify and hold harmless Genius Maker Themes from claims, damages, losses, and expenses (including reasonable legal fees) arising from your misuse of our themes, breach of these Terms, or violation of any law or third-party rights in connection with your store.

1. Changes to these Terms

We may update these Terms from time to time. The “Last updated” date will change when we do. Continued use of our products or website after changes constitutes acceptance of the updated Terms. Material changes may also be communicated on our store where appropriate.

1. Governing law and disputes

These Terms are governed by the laws of India, without regard to conflict-of-law principles, except where mandatory consumer protection laws in your country require otherwise.

Any dispute shall first be addressed by contacting geniusmakerthemes@gmail.com in good faith. If unresolved, disputes shall be subject to the exclusive jurisdiction of courts in Jaipur, Rajasthan, India, unless mandatory law in your jurisdiction requires a different forum.
